Defective Products
When a consumer is injured or killed while properly using a product, the law of products liability applies. Products liability law deals with injuries or death resulting from the use of a product which is defective due to its design, the manner in which it was manufactured, and/or the manner in which it was marketed or sold. Under the law, manufacturers, distributors and retailers have a legal obligation to ensure their products are designed and constructed to be safe to use or, in cases where the products could cause danger, provide adequate warning that a danger exists. Common theories of legal liability include strict liability, negligence, and breach of warranty.
After an accident involving a defective product, it is critical that the product be immediately secured and stored to prevent destruction. If you do not have the product, such as a defective automobile that is towed to a wrecker yard after an accident, immediately write and fax a letter to the person or company who has custody of the product and instruct them not to sell, destroy or dispose of the product until it can be examined by your attorneys and their experts. When a person or company receives such a letter, they are legally required to keep the product in a safe and secure location or face being sued for spoiling the product.
