Pedestrian and Bicycle Accidents

Operators of motor vehicles in the State of Florida are required to follow all traffic laws including paying attention to pedestrians and bicyclists. The most common causes of pedestrian and bicycle accidents are the following actions by drivers:
Under Florida law, the pedestrian or bicyclist has the burden to prove that the driver negligently caused the accident. Because of this, it is critical that all evidence be immediately obtained and documented, including taking photographs of the vehicle, obtaining statements from eyewitnesses and determining if the vehicle has a “black box” unit which may record vehicle speed.
