Under Florida law, the bicyclist has the burden to prove that the driver negligently caused the accident. Because of this, it is critical that all evidence be immediately obtained and documented, including taking photographs of the vehicle, obtaining statements from eyewitnesses and determining if the vehicle has a “black box” unit which may record vehicle speed.
